DPOA (Durable Power of Attorney)
Definition
A power of attorney that remains in effect if the principal becomes incapacitated. The 'durable' designation is what makes it useful for elder care planning.
A non-durable POA ends when the principal becomes incapacitated — exactly when you need it most. A durable POA stays in effect, so the named agent can continue to act on the principal's behalf.
Most financial powers of attorney for elder planning are durable. The healthcare equivalent is a healthcare power of attorney (or healthcare proxy).
